Section One: Terms and Conditions
1.1. The terms and conditions set out in this Annex relate to our Mobile (4G or 5G cellular) Broadband Service and are in addition to our general Trading Terms.
1.2. We may from time to time amend the Terms, Charges or Services. Whenever we make such changes, we will update the Website to reflect this and notify you in writing to your nominated email address that forms part of your Master Contact Details.
1.3. All definitions used in the main body of the standard terms apply to this Annex.
1.4. Any reference to a “clause” is to a clause of the general Trading Terms. Any reference to a “paragraph” is to a paragraph of this Annex.
- Use of the Services
2.1. To use the Mobile Broadband Service, you must purchase from us and keep active a Broadband Service;
- Upload and download speeds
Cellular broadband speeds will vary by location and can vary for reasons outside of the control of Globe2 Ltd; speeds may fluctuate throughout the day – no warranty is supplied as to the upload or download speeds available.
4.1. for the purposes of testing the signal, speeds and fitness for purpose, this contract can be cancelled with immediate effect at any point within 14 days of commencement of the contract (which for the avoidance of doubt will be on receipt of the router and SIM).
4.2 if cancelled within the 14-day period, a pro-rata charge will be applicable, from the day of commencement to the day of cease.
4.3 notwithstanding point 4.2, the contract can be cancelled with 30 days’ notice.
4.4 cancellation should be by calling 03333 446441 or in writing to email@example.com. An email shall be considered received once acknowledged by Globe2 Ltd.
4.5 in all cases, the router shall be returned in good working order with all accessories to Globe2 Ltd within 7 days of the cease of contract at the customers’ expense.
4.5.1 Proof of postage within the 7-day period shall be acceptable
4.6 failure to return the router as per paragraph 4.5 will result in a charge for the router at new market value.
4.7 routers returned damaged, or missing accessories may result in a restocking charge.
- Availability of the Broadband Service after suspension or termination
5.1. You will be unable to access the Broadband Service if:
5.1.1. in accordance with the Terms, we suspend your Broadband Service or terminate the Contract for either; or
5.1.2. our suppliers suspend or terminate the service.
5.2. If you choose to terminate the Contract for your relevant Broadband Service you will be unable to use the Service after the relevant notice period expires.
5.3. Where any of the suspension, termination or access-revocation events set out in paragraphs 5.2 to 5.3 occur, we will have no liability to you provided we act in accordance with the Terms.
6.1. Details of all prices in this Annex are exclusive of VAT.
6.2. The prices for our Goods and Services will be those which are agreed with you at the time of ordering the service.
- Fair usage
7.1. Default limitations
Unlimited bundles are truly unlimited where usage is appropriate to subscription type. Inappropriate usage would be considered as the following:
- Any usage outside normal commercial practice
- Any usage made via automated means (also see Gateway/AIT FUP)
- Any usage that damages or impairs the hosting network
- Any usage considered fraudulent, abusive, illegal or a nuisance
- Data usage where users regularly tether to 12 or more devices or have used 650GB of data twice within a 6 month period
- Data usage where roaming outside of the UK and exceeding more than 25GB within a single billing period
